Credit Hire Claims

The recovery of Credit Hire charges is one of the most defended areas of a claim following a road traffic accident.

More Information

This is because Defendant Insurers argue a number of issues which include but are not limited to the following:

  • Correct measure of loss
  • Enforceability
  • Need
  • Period
  • Rate
  • Impecuniosity
  • Mitigation

It goes without saying that law firms who are instructed to successfully recover credit hire charges know how to defeat such arguments and how best to overcome them. It is not a simple tick box exercise and requires a proper assessment of all the relevant factors at various stages of each case.

Problems occur when law firms instructed to deal with personal injury claims do not understand the arguments to deal with the hire element of a case. MJW Law represents many credit hire organisations who have a financial interest in road traffic accident claims and because of our process-driven systems, we have a proven track record for service and recovery.

We also assist on recoveries for credit hire only instructions on a fixed fee or percentage recovery basis depending on the volume of work and the amount for each case.

Credit Hire FAQs

Credit hire is the supply of a like-for-like replacement hire vehicle on a credit basis to the not-at-fault vehicle owner following a non-fault accident. Instead of paying for the vehicle at the time of hire, the credit hire company will attempt to recover the costs from the at-fault driver’s insurance once the claim is settled.

You can receive a hire vehicle from a ‘credit hire’ provider. These companies look at your accident circumstances and will offer you a hire vehicle if they agree that you weren’t at fault. Later on, in the process, they will make the other driver’s insurer pay for your hire.
